| 摘 要： | 全面地解决检察机关的定位问题需要研究体现权力与权利横向关系的客观义务问题。初步的工作包括界定概念与梳理内涵,需要分析讯问制模式、对抗制模式以及混合制模式的国家以及国际化趋势下的客观义务的各种表现形态。初步回答了针对客观义务的两种质疑,即客观义务与对抗制的兼容和其现实可能性。

| Abstract: | To define the role of the procuratorial organs,it is necessary to explore the problem of the objective obligation of the prosecutors which displays the relation between power and right.Preliminary steps to solve the problem include clarifying the objective obligation and analyzing its contents,comparing specific forms of the objective obligation under the inquisitional pro- ceedings,adversary proceedings,mixed proceedings as well as relevant international standards.It is also necessary to respond to two kinds of queries regarding the concurrence of the objective obligation and the adversary system and its practical possibility. |
